Terms

What you are buying, and what we promise

Plainly: what the $47 gets you, when it arrives, how the refund works, and the things our coaching is not.

This agreement

These terms cover the use of aquarushacademy.com and anything you buy from Aqua Rush Academy Swim School. Buying from us, or acting on advice we give you, means you accept them. If you are buying on behalf of a swimmer under 18, you are confirming you are their parent or legal guardian and that you accept these terms for both of you.

The water safety page is part of this agreement. If you read only one thing on this site, read that one.

What you are buying

We sell a one-off diagnosis, not a course and not a subscription.

  • The Stroke Diagnosis, $47. We look at your swimmer, name what is going wrong, explain what is causing it, give you drills that undo it, and tell you what to say from the side of the pool while it is happening.
  • The four-week add-on, $29. Optional, added at checkout. Four more videos or calls, four weeks of cover for anything new that comes up, and your recheck.

There is no subscription, nothing recurring, and no package you have to work through. When the diagnosis is delivered, the transaction is complete.

What we deliver, and when

You get at least three specific things you can act on: the problem named, what is causing it, the drills that undo it, in the order to do them, and what to say from the side of the pool while it is happening. It comes back in whatever form suits the problem: a written plan, a video with the footage marked up, or a phone call.

We aim to have it back to you within 24 hours of receiving what we need. The clock starts when we have something we can actually read, not when you pay. If your video is unusable we will tell you and ask for another, and the 24 hours starts again from there.

Filming is not required. If the swimmer cannot be filmed, or will not get in the water at all, tell us by email and we will work from what you describe, including things you can do out of the water.

What this is not

  • Not a swimming lesson. We do not put anyone in the water and we do not run sessions. We tell you what to do; you do it.
  • Not supervision. We are never present. Supervision is yours, always. See the water safety page.
  • Not medical advice. We are not doctors or physiotherapists. Nothing we send is medical advice, diagnosis or treatment.
  • Not a guarantee of results. We will name what we see and give you a plan. How fast anything changes depends on the swimmer, the practice they put in, and things neither of us controls.
  • Not a certification or assessment. What we tell you is our opinion, offered in good faith, based on what we can see.

Refunds

If we cannot name a problem from what you send us, we say so and refund the $47. We would rather give the money back than invent a problem.

Beyond that, because the diagnosis is our work and it is delivered once, we do not refund it because you disagree with the answer or because the swimmer did not practise. If you think we got something wrong, email us and tell us why. We will look again.

The $29 add-on can be refunded pro rata if you have not used it. Ask.

Your part of the deal

  • Tell us the truth about the swimmer, including their age, experience and any health condition that matters in water.
  • Supervise the swimmer at all times, and decide for yourself whether a drill is safe for them on the day.
  • Only send video you have the right to send. If anyone else is visible in it, that is on you to have sorted out.
  • Use what we send you for your own swimmer. Do not resell it, publish it, or pass it off as your own coaching material.

The video you send us

Your video stays yours. Sending it to us gives us permission to watch it, mark it up, and send it back to you with our notes on it. That is all.

We will not publish your video, use it in advertising, or show it to anyone else without asking you first and getting a clear yes. Video of children is not marketing material and we will not treat it as such.

Payment

Payments are handled by Stripe. We never see or store your card details. Prices are in US dollars and include nothing else, no shipping and no ongoing charge. Your receipt comes from Stripe by email.

Limits on our liability

To the fullest extent the law allows, our total liability for any claim connected to what you bought is limited to the amount you paid us for it.

We are not liable for injury, loss or damage arising from swimming, from practising drills, or from any use of advice we provide. The water safety page sets this out in full, including what these limits do not cover.

Nothing in these terms limits liability for our own gross negligence, recklessness or intentional misconduct, or takes away rights that cannot be waived under the law that applies to you.

Governing law

Aqua Rush Academy operates from California. These terms are governed by California law, without regard to its conflict of law rules, and any dispute arising out of them belongs in the state or federal courts of California.

If a court decides any part of these terms cannot be enforced, the rest of them still stand.

Changes to these terms

We may update these terms. The date at the top of this page tells you when they last changed. What applied on the day you bought is what governs your purchase.
